Terms & conditions
1. Acceptance
By purchasing a LEVELSTAT device, creating an account, or using the LEVELSTAT website, dashboard, or data feed (together, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. The service
LEVELSTAT provides water-level and temperature sensors, a cellular data path from those sensors to our servers, a web dashboard to view readings, and related features. We may add, change, or remove features at any time.
3. Your account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. You must be at least 18 years old, or the age of majority where you live, to create an account. Provide accurate information when you sign up and keep it current.
4. Devices and subscriptions
Hardware purchases are billed at the price listed at the time of order. Subscriptions renew automatically at the interval you selected (monthly or annual) at the then-current rate, charged to your payment method on file, until you cancel. You can cancel a subscription at any time from your account; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
Access to the dashboard and historical readings depends on an active subscription for your site. If your subscription lapses or is cancelled, the device may stop reporting, and any data associated with the account becomes inaccessible to you. LEVELSTAT may retain that data for historical, operational, or research purposes, or may permanently delete it, at its sole discretion. You are not entitled to a copy of, or to any guarantee of retention for, data collected during a subscription that has lapsed or been cancelled.
5. Your data
How we collect and handle sensor readings and account information is covered in our privacy policy. In summary: sensor reading data is the property of LEVELSTAT and may be shared, licensed, or sold — tied only to physical location, never to your identity. Account information is never sold or shared with third parties for their own use.
6. Intellectual property
The LEVELSTAT name, wordmark, website, dashboard, software, firmware, designs, and documentation are owned by LEVELSTAT and protected by copyright and trademark law. These Terms do not grant you any right to use the LEVELSTAT name or marks for your own purposes.
7. Acceptable use
You agree not to:
- use the Service in any way that violates applicable law or the rights of others;
- attempt to reverse engineer, decompile, or extract the source code of our firmware or server software, except to the extent this restriction is prohibited by law;
- scrape, automate, or abuse the Service in a way that interferes with other users or imposes an unreasonable load on our infrastructure;
- resell the Service, or repackage sensor data from the Service for commercial redistribution, without prior written permission from LEVELSTAT;
- tamper with, move, or redirect another user’s device without authorization.
8. Warranties and disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. LEVELSTAT does not guarantee uninterrupted service, accurate readings at all times, or that data will never be delayed, lost, or corrupted. LEVELSTAT is not responsible for the performance of third-party providers we rely on — including hosting, cellular connectivity, payment processing, and email — or for any resulting downtime, data loss, or data breach.
LEVELSTAT devices measure environmental conditions and are intended for informational and operational awareness. They are not life-safety equipment and should not be relied on as the sole indicator for flood response, dam operation, rescue decisions, or any other safety-critical use.
9. Limitation of liability
To the maximum extent permitted by law, LEVELSTAT and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Service. LEVELSTAT’s total liability to you for any claim arising out of these Terms or the Service will not exceed the amount you paid to LEVELSTAT in the twelve months preceding the claim.
10. Indemnification
You agree to defend and indemnify LEVELSTAT from and against any claims, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.
11. Termination
You may stop using the Service at any time and cancel your subscription from your account. LEVELSTAT may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the platform. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will continue to apply after termination.
12. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of the page reflects the most recent revision. For material changes, we will give reasonable notice — for example, by email or a notice on the dashboard — before the change takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the United States and the State in which LEVELSTAT is organized, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in that State, and you consent to that jurisdiction and venue.
